In the following sections we would like to fulfil our obligation to inform you about your rights and our handling of your data. The GDPR is legally binding from 25 May 2018 and stipulates in detail the information which must be made available to the customer or other relevant persons about the processing of their personal data. We are happy to comply with this legal obligation.

4. Collection, processing and storage of data

Data protection is very important to us. Therefore, we comply strictly with the legal provisions when collecting, processing and using your personal data. In principle, we only process the data that we receive from you directly on the basis of our business relationship with you or for the purpose of initiating a business relationship with you. This occurs when you conclude a contract with us, request a quote, subscribe to our newsletter, create a customer account, take part in a competition, inform us about changes to your data, send us an enquiry or contact us with queries or complaints about an order. This data will only be used by our service providers in order to perform their tasks. Any other use of the information is not permitted and will not be carried out by any of the service providers entrusted by us.

If we collect data about you from third parties, this is expressly specified in the following descriptions of the processing procedures.

4.1. Processing for the purpose of fulfilling a contract with you or within the framework of precontractual measures (Art. 6 (1b) GDPR)

4.1.1. Order

In the course of processing an order we collect and store the necessary personal data for the fulfilment of the contract concluded with you. This data is personal master data, such as: First name and last name, address, date of birth, telephone number, e-mail. If you select purchase on account, a credit assessment is carried out.

We may forward the data required to process your order, including the data required for the billing our service providers, to companies cooperating with us for this purpose. These companies may be printing companies, logistics companies, e-mail service providers, product personalization service providers or external payment service providers. By selecting following payment options: Credit card or PayPal your order data will be transmitted to the respective payment service provider for the execution of payment. Article 6 (1) b of the GDPR (General Data Protection Regulation) provide the legal basis for this process. Naturally, all personal data is treated confidentially.

We obtain information for verifying your address via infoscore Consumer Data GmbH, Rheinstr. 99, 76532 Baden-Baden (for customers in Germany and Switzerland), Credify Informationssysteme GmbH, Gumpendorfer Strasse 21, 1060 Wien (for customers in Austria), Experian Nederland BV, Kantoorgebouw't Schip, Verheeskade 25, 2521 BE Den Haag (for customers from the Netherlands). 

For this purpose, we transfer the necessary data (your full name, address and, if applicable, date of birth) to the above companies. They will also use the data for the purpose of address verification or identity checks on behalf of other companies as well as for relevant website scoring applications. Scoring is a means of calculating the probability of certain future behaviours, based on mathematical/statistical methods, and uses appropriate data for this purpose. All personal data is treated with the utmost confidentiality.

Purchase receipts are stored for accounting reasons in accordance with the statutory limitation period (6 or 10 years)

4.2. Processing based on your consent (Art. 6 (1a) GDPR)

4.2.1. Creation of a customer account and newsletter dispatch

When a customer account is created in our online shop you specify your email address, first and last name, address, telephone number and date of birth. We can use your personal data to contact you with regard to your account or your transactions with us. Your data will be stored in our customer database and erased at your request (see Point 9).

When you activate Newsletter Dispatch via our online shop, this takes place through the so-called "double opt-in" procedure. This means that before sending the first newsletter, we send you a confirmation email, in which you are asked once again whether you wish to receive our newsletter. When you confirm the contained link, we send you our newsletter. We use a German service provider to forward our newsletter. We use personal data relating to the use of the newsletter both for statistical purposes and for optimised addressing of the reader with regard to company-specific information, products and services as well as for advertising purposes. You can unsubscribe from the newsletter at any time free of charge by using the link provided at the end of each newsletter. You can also contact us by email or by post using the addresses specified under Point 9.

4.2.2. Participation in competitions

In the case of competitions, we use data for the purposes of notifying winners and advertising for the products that we offer. Your data is stored in our customer database. You will find detailed information in our conditions of participation for the respective competition. By submitting the competition participation, you consent to data processing for the above-mentioned purpose. Of course, we will erase your data at your request. This data will be deleted after three years at the latest.

4.2.3. Application for the LouisCard

When you apply for our discount card, the LouisCard, we record your personal master data, such as your name, mailing address, telephone number and/or email address, and store them in our customer database. For the dispatch of the LouisCard, we forward your address to our service provider Boyens direct mail GmbH & Co. KG, based in Marne, Germany. Your data is not stored by the service provider.

4.3. Within the scope of the balancing of interests (Art. 6 (1f) GDPR)

We only process your data in addition to the actual fulfilment of a contract or an enquiry where necessary in order to safeguard our legitimate interests or those of third parties in the following circumstances:

  • Information about video surveillance in our branches as indicated there
  • Targeting customers directly for advertising purposes
  • Guaranteeing IT security within the company
  • Prevention and clarification of possible criminal offences
  • Measures for further developing services
  • Measures for business management
  • Advertising and marketing measures, provided you have not objected
  • Pseudonymous storage of data via cookies

We will merge guest orders placed by already registered customers with this customer account in order to ensure uniform customer communication and to be able to maintain a coherent, consistent database. The merging will be carried out as soon as data already known to us is used (e.g. e-mail address, date of birth, postcode). If you object to this use of your data, please contact the following e-mail address before you complete your order: service@louis.eu.

4.3.1. Email newsletter for existing customers

If you have purchased a product from us, we may also send you our email newsletter for customer information. The same conditions as listed under Point 4.2.1 apply to opt-out and dispatch.

4.3.2. Communication with Louis (by email, telephone, contact form)

When you contact our support department by email, phone or contact form we may record your personal details, such as your name, mailing address, telephone number and/or email address. The data is used to compare your stored customer details and are only used and further processed internally by customer service employees. We may access your customer account in the course of this in order to be able to offer you the required support.

In case of financing at the store, we reserve the right to carry out an automated credit check.

Microsoft Bookings:

Our website uses the online appointment scheduling service Microsoft Bookings (part of Microsoft Office 365) from Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18 D18 P521 ("Microsoft" below). This software enables you to make an appointment with a member of staff at your local Louis store (Detlev Louis Motorrad- Vertriebsgesellschaft mbH). To connect to this service, you need to call up the online booking function via a link or button on our website, in an email or in the Newsletter. For the purpose of arranging your appointment, the information you enter in the Appointment Form is transmitted to Microsoft. For further information about how your data is handled, please go to Datenschutzerklärung von Microsoft. The legal basis for processing your data in relation to the "Microsoft Bookings" service is Art. 6 (1) Sentence 1 (f) GDPR (Legitimate interest in processing data). The legitimate interest derives from our goal of offering you a user-friendly website with a wide range of functions and enabling you to arrange an appointment with a member of our staff quickly and easily whenever you need to. We would emphasise that you are not under any obligation to use Microsoft Bookings for arranging an appointment. If you do not wish to make use of this service, please use one of the other contact options that we offer instead.

5. Information on data services in the online shop

Log files are stored when you access our website. We do not attribute this data to any individual. We also do not combine this data with any other data sources, nor do we compare it. Anonymised data is used solely for the purposes of carrying out a statistical evaluation of your visit to our website. This data is erased after the statistical evaluation.

5.1. Data services used

Bing Ads: This website uses Bing Ads from the Microsoft Corporation (Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA; “Microsoft”). Bing Ads uses "cookies", which are text files placed on your computer in order to analyse how you use the website. This cookie has limited validity and is not used for personal identification. When you visit specific pages on our website and the cookie has not yet expired, we and Microsoft can see that you have clicked on the ad and were directed to this site. The information that is gathered using the cookie is used for compiling sales statistics. We find out the total number of users that has clicked on one of our ads and been directed to a page with a conversion tracking tag. However, personal identification of these users is not possible. The processing is effected on the basis of Art. 6 (1) (f) GDPR with the legitimate interest in targeted advertising and the analysis of the impact and efficiency of this advertising. You have the right to object to this processing of your personal data based on Art. 6 (1) (f) GDPR at any time. You can prevent the cookies from being stored by selecting an appropriate setting of your browser software. However, we should point out that in this case, you may not be able to make full use of all of this website's functions. You will not as a result be included in the conversion tracking statistics. Google Ads: This website uses Google Ads, an online advertising programme provided by Google Inc. (“Google”). Google Ads is a conversion tracking tool that helps us to analyse visitor behaviour. These Cookies do not contain personal data and are therefore not used for personal identification. In addition, they only have a limited validity. Remarketing or “similar target groups” function of Google Inc.: This website uses the remarketing or “similar target groups” function of Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). This function serves the purpose of analysing visitor behaviour and visitor interests. Google places cookies to analyse website use, which forms the basis for the creation of interest-based ads. With the help of these cookies, website visits and anonymised data on use of the website are recorded. No personal data of website visitors are stored.

If you visit another website in the Google Display Network afterwards, ads will be displayed that are highly likely to include previously accessed product and information areas. Your data may also be transmitted to the USA. An adequacy decision by the European Commission applies for data transfers to the USA. Quantum Metric: This website uses Quantum Metric, a web analytics service provided by Quantum Metric Inc ("Quantum"). RichRelevance®: In order to optimise our website and make it as user-friendly as possible, we collect and store anonymised data using solutions and technologies from RichRelevance®. 6. Consequences of not providing your personal data

Your personal data is processed in accordance with the GDPR applicable in the EU and the German Federal Data Protection Act (BDSG) as well as all other relevant legislation. We require the personal data you provide in order to conclude the contract.

It is not possible to conclude or provide a service or dispatch your goods without the provision of your personal data!

7. Transfer to third countries (Art. 13 + 14 (1f) GDPR)

Transfer of personal data to a country outside the European Economic Area (EEA) takes place as described below.

We use the Content Delivery Network (CDN) from Akamai for the provision of contents and for load distribution for our online shop. Owing to the type of service provided by Akamai, the data of visitors to our website may in some cases be transferred to third countries outside the EU/European Economic Area (EEA). We have concluded a corresponding agreement with Akamai, as a service provider based in the USA, to safeguard the rights of our affected customers, for which an adequacy decision has been received from the European Commission (implementation decision (EU) 2016/1250 of the (Privacy Shield)), Commission.

We use web teams in Serbia for some programming services. An adequacy decision has not been adopted by the European Commission for Serbia. Therefore, we have concluded a contract with the service provider with standard contractual clauses.

In cases where customers have initiated an order in our online shop from outside the EU or the EEA, personal data is transmitted to these countries in order to fulfil the contract with them, should this is necessary or stipulated by law in order to process their order.

8. Storage period (Art. 13 (2a) GDPR)

Unless specified or precisely defined above, we store your personal data as a data controller only for the period that is necessary to achieve the storage purpose or according to the regulations, laws and directives of the European legislator or the national laws.

If the storage period stipulated by the legislators expires or if the necessity for storage no longer applies, the personal data is routinely disabled or erased according to the statutory requirements.

The retention period is based on the term of our contracts, the statutory periods of limitation, which are normally three years under the German Civil Code (BGB), or detailed specifications from the German Tax Code, the German Commercial Code (HGB) and other legal provisions.

If you wish us to erase your customer account, the existing data is also completely erased from our data carriers within ten years in the course of our backup.

9. Data subject's rights (right to information, rectification, erasure, restriction and objection according to Art. 13 (2b) GDPR)

You can assert your rights granted by the legislator at any time. These are essentially the following rights:

  • Right to rectification (Art. 16 GDPR)
  • Right to erasure (Art. 17 GDPR)
  • Right to restriction of processing (Art. 18 GDPR)
  • Right to object (Art. 21 GDPR)
  • Right to data portability (Art. 20 GDPR)

You have the right to obtain information about your personal data stored by us at any time. Likewise, you have the right to rectification, blocking of, or, apart from the mandatory data storage for the purposes of conducting business, erasure of your personal data. We shall respond to your requests for information in an encrypted form in order to guarantee data protection.

In order to be able to consider a data lock at any time, it is necessary to keep the data in a lock file for control purposes. You can also request the erasure of data as long as no legal archiving obligation exists. Insofar as such an obligation exists, we can block your data on request. You can make changes to or revoke your consent by notifying us accordingly with effect for the future.

Of course, we shall also provide you with information at any time regarding any of your personal data stored by us. We would be happy to rectify or erase this data upon request, provided no statutory retention obligations preclude it. As a result of your objection your personal data will no longer be distributed, unless we can prove that there are compelling protection-worthy reasons for the processing which outweigh your interests, rights and freedoms or the processing serves to assert, exercise or defend legal claims.

If your personal data is also processed within the framework of the statutory provisions for the purposes of direct advertising, you can also object to this processing. If you object to the processing of your personal data for the purposes of direct advertising, they will no longer be processed for this purpose.

Your objection will be effective for the future. This objection can be made informally. If possible, send your objection to the above-mentioned contact details of the data controller.

12. Processing of personal data for a purpose other than that for which the they were collected (Art. 13 (3) GDPR)

We do not plan to carry out such processing.

In the event that we plan to process your personal data for a purpose not specified above, we shall inform you in advance within the framework of the statutory provisions.

13. Secure data transfer

We protect your data with a secure SSL connection. Code length: RSA 2048 Bit/128 Bit. The user data is encrypted by a maximum of RC4 128 Bit, Triple-DES 168 Bit or AES 256 Bit, depending on the browser's functionality.

All data is encrypted during the order process, e.g.

  • last name, first name, address, telephone number, etc.
  • Chosen method of payment
  • Credit card and account information

Furthermore, we protect our websites and other systems against loss, destruction, access, modification or dissemination of your data by unauthorised persons by means of technical and organisational measures.

14. Change to our data protection provisions

In order to comply with the current legal requirements or to adjust the data protection declaration should our services change (e.g. introduction of new services), we reserve the right to amend this occasionally.

Therefore, the new data protection declaration will apply when you revisit our website.
